Completeness and purpose

These general conditions are the only ones applicable and replace all other conditions, unless prior, express and written exemption. The general conditions are accessible at any time on the site and prevail, where applicable, over any other version or any other contradictory document. Each purchase on the site is governed by the general conditions applicable on the date the order is placed.

The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by Maar to the buyer.

  • Order

The buyer has the option of placing their order online, from the online catalog and using the form provided there.

The order process consists of three (3) successive steps. Once you have made your choice of products (colors, quantity), and your basket has been validated, you must:

  • Product information

The products governed by these general conditions are those which appear on the website www.maarliving.com and which are indicated as sold and shipped by Maar. They are offered while stocks last.

Maar takes the greatest care in putting information online relating to the essential characteristics of the products, in particular by means of detailed descriptions and photographs illustrating the products.

However, if errors or omissions may have occurred in this presentation, Maar cannot be held responsible.

The photographs of the products are not contractual.

  • Price

Maar reserves the right to modify its prices at any time but undertakes to apply the prices in force indicated at the time of the order, subject to availability on that date.

Prices are in euros. They do not take into account delivery costs, invoiced additionally, and indicated before validation of the order. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store. The online provision of the buyer's bank card number and the final validation of the order will constitute proof of the buyer's agreement in accordance with the provisions of the law of March 13, 2000 and will be worth:

  • Proof of transaction

Computerized records, kept in Maar's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

  • Right of withdrawal with refund

In accordance with the legal provisions in force, the buyer has a period of fourteen (14) days from the date of receipt to exercise his right of withdrawal from Maar, without having to justify reasons or pay a penalty, at provided that the product(s) is (are) returned in its (their) original condition, within fourteen (14) days following communication of the withdrawal decision.

The buyer is reminded that, in accordance with article l. 221-19 of the Consumer Code:

.The day on which the contract is concluded or the day of receipt of the product is not counted in the period of fourteen (14) days mentioned above;

.The time limit begins to run at the start of the first hour of the first day and ends at the end of the last hour of the last day of the time limit;

.If this period expires on a Saturday, Sunday or public or non-working holiday, it is extended until the first following working day.

Damaged or incomplete products will not be taken back.

The right of withdrawal can be exercised by contacting the buyers service by email: customerservice@maar.fr . The costs of returning the package are covered by Maar. As soon as the return request is validated internally, Maar's buyers service will send you instructions by email as well as a prepaid return label that you will stick on the package.

If the aforementioned conditions are met, Maar will reimburse the buyer for their order, except for delivery costs, on the day of receipt of the returned products.

  • Guarantee

The products sold are covered by a commercial guarantee aimed at guaranteeing their conformity and ensuring reimbursement of the purchase price, replacement or repair of the goods.

It does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the products.

The preceding provisions do not exclude the application of the legal guarantee of conformity of article l. 211-4 of the Consumer Code and the guarantee of the item sold in Articles 1641 et seq. of the Civil Code.

Transfer of ownership – transfer of risks

The transfer of ownership of the products to the benefit of the buyer will be carried out after payment of the price by the latter, regardless of the delivery date of the products.

In accordance with the provisions of article l216-4 of the Consumer Code, the transfer of the risks of loss and deterioration relating thereto will only be carried out at the time when the buyer takes physical possession of the products.
